These Terms govern access to and use of the OxanaTozArt website and online services.
Purchases are additionally governed by the relevant artwork information, Shipping & Delivery Policy, Refund, Return & Cancellation Policy, and applicable distance-sales information.

2. USE OF THE WEBSITE
The website may be used for lawful purposes, including viewing, purchasing, and enquiring about artworks.
Users must not interfere with the security or operation of the website, attempt unauthorised access, introduce malicious code, manipulate checkout or inventory fraudulently, impersonate another person, or use the website in violation of applicable law.
3. ARTWORK INFORMATION
OxanaTozArt takes reasonable care to present artwork information accurately.
Photography, lighting, screens, and device settings may affect the appearance of colour and texture.
Material information relating to the artist, medium, dimensions, framing, availability, signature, documentation, and production model is provided on the relevant artwork page where applicable.
4. ONE-OF-A-KIND ARTWORK
Where an artwork is identified as One of a Kind, the collector purchases the exact original physical artwork described and shown.
Once sold, that exact original is no longer available for purchase.
5. MADE-TO-ORDER ARTWORK
Where an artwork is identified as Made to Order, a new work is individually hand-painted after purchase according to the production model disclosed on the product page.
Natural artistic variation is part of the hand-painted process.
Made-to-order artwork is not a print or mechanically reproduced copy.
Any customer-specific customisation must be expressly agreed.
6. PRICES AND PAYMENT
Prices are displayed in the currency shown at checkout.
Shipping and other charges collected by OxanaTozArt are disclosed before purchase where required.
International customers may be responsible for destination-country import charges unless expressly stated otherwise.
Payment is processed through the payment methods made available at checkout.
7. ORDERS
Orders are subject to successful payment authorisation, artwork availability, and lawful security or fraud-prevention checks.
OxanaTozArt may refuse or cancel an order where permitted by law because of payment failure, fraud risk, an obvious pricing or technical error, inability to supply the artwork, or a legal restriction.
Where payment has been collected and a refund is due, it will be processed according to applicable law.
8. INTELLECTUAL PROPERTY
Purchase of a physical artwork transfers ownership of the physical object only.
Unless expressly agreed in writing, purchase does not transfer copyright, reproduction rights, publication rights, adaptation rights, merchandising rights, digital exploitation rights, or other intellectual-property rights.
Artwork images, photographs, videos, written content, graphics, and branding remain protected to the extent provided by applicable law.
9. THIRD-PARTY SERVICES
The website uses Shopify and may rely on independent payment, shipping, customs, communications, security, or other service providers.
Independent services may be governed by their own terms and privacy practices.
10. WEBSITE AVAILABILITY
OxanaTozArt aims to keep the website accurate and available but cannot guarantee uninterrupted or error-free operation.
We may correct errors, update content, perform maintenance, or modify functionality where reasonably necessary.
Nothing in these Terms excludes liability that cannot legally be excluded.
11. PRIVACY
Personal information is handled in accordance with the OxanaTozArt Privacy Policy and, where applicable, the GDPR Information Notice (Privacy Policy), structured in compliance with Regulation (EU) 2016/679 (GDPR).
12. GOVERNING LAW AND MANDATORY RIGHTS
These Terms are governed by the laws of Romania.
However, nothing in these Terms deprives a consumer of mandatory protections applicable under the law of the consumer's habitual residence where those protections cannot lawfully be excluded.
13. CHANGES
These Terms may be updated prospectively when legal, operational, or technical circumstances change.
Changes do not retrospectively remove rights already acquired under applicable law.
